New research by Filippo Lancieri, Luigi Zingales, and Eric Posner supplies data on supreme court justices’ record of antitrust enforcement. In their paper, the authors present several scores for each US supreme court justice going back to the 1950s.
The data was hand-collected and sorted, and it clearly depicts the Court’s tectonic shift against the enforcement of antitrust laws since the 1970’s
The authors argue that antitrust enforcement has been declining since the 1960s, not as a result of lower popular support, but as a result of several factors including the influence of big business, the rising pay of the private sector, and the decisions made by regulators and judges.
